I am writing in response to your letter to Daniel David of this office dated 2/26/97 requesting an exemption from regulation as a manufacturing facility as described in 6 NYCRR Part 360-12.1(b)(2). This exemption applies to facilities which accept a single general type of source separated, nonputrescible recyclable, including, but not limited to glass, plastics, metals or paper, and which produces through physical or chemical transformation of the material, a marketable product that is then leased, sold, used by a manufacturer or offered for sale or offered for promotional purposes to a consumer as a product and is not disposed of by the manufacturer. Facilities, such as yours, which store or process more than one type of recyclable in the manner noted above must receive a written exemption from this department.

Based upon the information provided with your letter, the Rochester Computer Recycling and Recovery facility is considered exempt from regulation under Subparts 360-11 and 360-12 as a manufacturing facility in accordance with 360-12.1(b)(2).
