The SHIELD Act: What you need to know

THE S.H.I.E.L.D ACT (STOP HACKS AND IMPROVE ELECTRONIC DATA SECURITY ACT) EFFECTIVE SPRING OF 2020; HAS BEEN CREATED WITH A STRONG DATA SECURITY FRAMEWORK IN MIND TO CONTROL AND ELIMINATE DATA BREACHES, AND IDENTITY THEFT.

In this Act, any person or business that owns or licenses computerized data which includes private information of New York residents must comply with breach notification requirements and have a policy in place for data-enabled devices. Information relating to private or personal information such as credit card numbers, email addresses, passwords and even personal characteristic information that identifies unique information about a natural person applies.

Organizations that conduct business in New York State should be evaluating and reviewing their current data security policy’s and invest in security programs that comply with the SHIELD Act’s updated framework. Violations could impose penalties of $20.00 per violation to a cap of $250,000.
